Below we set out the general rental conditions.
Despite all the conditions and rules, we only have one goal and that is that you have a very nice and carefree holiday period with us in the villa!
Ultimately, we would like you to be satisfied with your stay.
Article 1: Application
- These General Rental Conditions apply to reservations and agreements relating to our Villa Jolla Javea located at the address: Carrer de la Perera 3, Xabia/Javea, Alicante, Spain.
- In these General Hire Conditions, the term ‘Hirer ‘ means the person who enters into an agreement with us in relation to rental of the holiday home. The Hirer is obliged to impose the General Hire Conditions on its travelling party and the Hirer will ensure compliance with these rules/conditions.
- In these General Rental Conditions, ‘we’, ‘us’ and ‘Lessor ‘ should be understood to mean the owners of Villa Jolla Javea (Jacobine and Remco van der Ploeg. P.O. Box 1436, 3260 AK Oud-Beijerland The Netherlands. E-mail address: info@villajollajavea.com).
- These General Rental Terms and Conditions apply regardless of your (prior) reference to any terms and conditions of your own or other general terms and conditions. We reject any General Rental Terms to which you refer or which are used by you.
- Agreements deviating from these General Rental Conditions are valid only if agreed in writing.
Article 2: Conditions of reservation, bookings made directly through our website:
- We only accept reservation requests from persons aged 18 or over. Groups of young people will not be allowed. We have the right to refuse a reservation due to age or composition of Tenant(s)’ travel party. When booking, you must indicate the composition of the party that will be staying in our villa.
- After making a reservation request, you will receive a confirmation, the General Rental Conditions and an invoice from us. Please check these documents for accuracy and inform us immediately of any inaccuracies.
- Only after receipt of the confirmation and payment of the down payment (article 3) the agreement comes into effect. The agreement concerns the (re)letting of the holiday home for recreational use, which by its nature is of short duration pursuant to Article 7:232 paragraph 2 of the Civil Code. The rental agreement shall end automatically after the expiry of the agreed rental period.
Article 3: About booking and payment directly through our website
- We ask you to transfer 40 % of the rent to us within 14 days of the invoice date. The other 60 % of the total amount must be paid to us no later than 30 days before the arrival date. If your reservation is within 30 days of the arrival date, you must pay 100% of the invoice amount to us in one go upon receipt of the invoice.
- The deposit and/or payment should be transferred the bank account number as stated on the invoice.
- By paying the deposit of (or total) rent, you confirm having read and agreed to the General Rental Conditions.
- If the amounts invoiced to you are not paid on time, you will be in default after the payment deadline has expired. In that case, we reserve the right to cancel your reservation and dissolve the agreement. Naturally, you will receive a reminder prior to this decision.
Article 4: Deposit when booking directly through our website
- The deposit for Villa Jolla Javea is € 400,-
- The deposit serves to guarantee damage and/or costs -in the broadest sense of the word- in the event of non-compliance with the obligations of the Renter and the person(s) accompanying the Renter.
- The deposit must be paid in cash upon check-in. If the deposit is not paid, we are entitled to deny the Renter access to the villa. If you fail to pay the deposit, we are also entitled to dissolve the contract with immediate effect. In that case, there will be no refund of the (down)payment.
- The deposit, or any balance thereof, after settlement of claims (damage to inventory/holiday home and/or other costs) from us to the Renter will be returned in cash upon check-out. Any (further) claims for compensation are not cancelled by this refund. Should it not be possible to ascertain the damage and/or costs at the time of check-out, we reserve the right to retain the full deposit until the damage and/or costs have been ascertained.
Article 5: Final cleaning costs
- The cost of the final cleaning is € 150,- and will be charged on the invoice and must be paid as described in article 3. The final cleaning takes place between changes of tenants and is intended to restore the villa to optimum hygiene for our guests.
- During your stay, there will be no cleaning of the villa other than garden and pool maintenance.
- Upon arrival, you can expect a clean house and clean made beds. Bed linen, towels and kitchen linen are included. Should you require new bed linen, towels and kitchen linen during your stay, please let us know. Charges will be made, see our page tariffs on the website.
Article 6: Check-in and check-out
- On the day of arrival, you can normally use the villa from 16:00.
- On the day of departure, you must have left the holiday home by 11:00. Adjustments in times can be made by mutual agreement.
- Key reception is by mutual agreement. Upon arrival, you will be given a tour and explanation of specific things in the house.
- The key remains our property. In case of loss, theft or any other way of losing the key(s), the Renter will owe an amount of € 150,-
- All costs incurred due to your failure to deliver the property on time will be recovered from you.
- Goods found after your departure will be kept for you for a reasonable period, but we take no responsibility for them. Returning them can only be done at your expense.
Article 7: Legitimation requirement
- We ask you to provide us with your identification details via email before your arrival date so that we can report your stay to the local authority. Villa Jolla Javea treats personal data with care and ensures that the privacy of guests is maintained. Please see the privacy statement on our website www.villajollajavea.com
Article 8: Amendments
- If, after the conclusion of the booking/contract, the Hirer wishes to make changes to the booking, we are not obliged to comply with them. It is at our discretion whether and to what extent the desired changes are accepted. In principle, changes within 30 days prior to arrival cannot be permitted.
- If, after the booking/agreement has been made, the Renter wishes to change the period of stay to a different or non-consecutive/connected period of stay, the cancellation provisions set out in Article 9 shall apply. A different period of stay shall in any case mean a period that is not within the period of stay booked by the Tenant (and confirmed by the Landlord).
Article 9: Cancellation
- Cancellation by the Renter must always be made in writing (by e-mail). The following rules apply.
- Deposits will not be returned in case of cancellation. In case of emergencies, a reasonable solution will be sought upon proof.
- If cancelled within 30 days before the day of arrival, 100% of the rent will be charged.
- If cancelled up to 30 days before the day of arrival, 30% of the rent is due.
- Did you book your stay 14 days or less ago and your arrival is not within 30 days? Then you do not pay a cancellation fee.
- If you have not arrived within 24 hours of the agreed date without further notice, this will be considered a cancellation and 100% of the rent will be due. Of course, we will try to contact you in advance to clarify the situation first and rule out calamities
- We are entitled to cancel the contract without giving reasons up to 30 days before the date of arrival. In the event of cancellation on our part, any amount paid shall be refunded and we shall not be liable for damages.
Article 10 Liability/ complaints/ damages
- The Tenant and other users are fully liable for all damage caused to the house, its inventory and all items belonging to the rented property during the respective rental period, unless the Tenant and other users can make it plausible that the damage cannot be attributed to them. We therefore recommend that you carefully inspect the holiday home and its inventory for defects and shortcomings on arrival. If you notice any damage or defects, please report this to us immediately.
- We accept no liability for theft, loss or damage of or to property or persons of any kind during or as a result of the stay in the holiday home.
- We accept no liability for any construction activities and/or noise pollution in the vicinity of the rented villa.
- We accept no liability in case of failure or malfunction of technical equipment, utilities, non-functioning or partial non-functioning of the Internet. Naturally, we will make every effort to solve such problems as soon as possible by engaging the responsible companies.
- The costs of normal maintenance and repair of defects are at our expense. If defects occur, Tenant must notify us immediately and follow our instructions to the extent possible. Any costs incurred by Tenant in this respect will be reimbursed to Tenant by us against submission of itemised invoices.
- Our villa offers free WiFi. You can enjoy this both indoors and on the terraces and by the pool. We assume that you use the internet correctly and with respect. By this we mean the illegal downloading/ uploading or streaming of material from the internet! The Renter is responsible and liable for his/her own internet use and if fines are imposed, these will be passed on to the Renter. The Renter’s/offender’s personal data will be disclosed at the request of authorities/copyright holder(s). All costs to be incurred by the Landlord in connection with such infringement will be recovered from the Renter.
- Should you wish to make a complaint, it must be submitted to us in writing, stating reasons, within 14 days of leaving the holiday home.
Article 11: Bookings and cancellations via cooperating booking sites
- Of course, you can also book our holiday villa via the cooperating booking sites, For the conditions surrounding bookings, cancellations and payments, privacy policy please refer to the general terms and conditions of these sites.
Article 12: Applicable law and disputes
- All legal relationships, including the rental agreement concluded in respect of Villa Jolla Javea and any disputes arising therefrom, shall be governed exclusively by Dutch law, even if all or part of an obligation is performed abroad or if the party involved in the legal relationship is domiciled there. The applicability of the Vienna Sales Convention is excluded.
- The Rotterdam District Court shall have exclusive jurisdiction over disputes relating to the conclusion, interpretation, performance or termination of the rental agreement. Nevertheless, we are entitled to submit the dispute to the court with jurisdiction according to the law.
Article 13: Important house rules
- The holiday home is non-smoking. Smoking is allowed outside on the terrace. Cigarettes may only be extinguished in ashtrays.
- Villa Jolla Javea is a luxury holiday villa in a quiet neighbourhood and we ask you to be considerate of the surroundings. Of course, playing soft music is no problem but Villa Jolla Javea is not a party house and noise pollution is not accepted.
- Be careful with fire and the flammability of nature due to persistent drought and heat! No open fire should be used outside.
- Villa Jolla Javea is equipped with the necessary safety equipment and materials such as smoke detectors, fire extinguisher, fire blanket, carbon monoxide detector and first aid kit. In case of emergencies, leave the villa and take care of your own safety first. Then always contact us immediately and call 112 if necessary. In all holiday homes you will find telephone lists with the most important emergency numbers. Of course, we also ask you to handle appliances, gas cookers, stoves and the like adequately, responsibly and with care.
- Changing empty gas cylinders to full ones is done by us.
- Enjoy the pool. Be careful of the shallow areas. Diving is not allowed.
- To ensure proper hygiene of the pool water, the pool is checked and cleaned once a week (on Tuesday mornings around 8.30am) and twice a week (on Tuesday and Saturday mornings) in summer.
- In spring and autumn, the pool is heated (on request). You can then also use the central heating in the villa.
- Every Tuesday morning around 8.30am, the villa’s garden is maintained.
- You are expected to dispose of rubbish in a timely manner. There are rubbish containers at every main road lead. Here you can deposit your rubbish free of charge. Leaving rubbish bags behind after your holiday period will be deducted from the deposit at €25 per rubbish bag.
- Bringing pets is not allowed.
- Barbecuing with the provided BBQ is allowed (it must be left clean before leaving the house). Although the use of gas, water and electricity is included, we ask you to use them sparingly.
- Subletting or re-letting is expressly prohibited.
- Staying more persons in a holiday home than agreed on the reservation, or more than the applicable maximum number of persons for the home, is expressly not allowed without our permission, unless otherwise agreed in writing. This may lead to premature termination of the rental agreement on our part, without refund.
- Cots are available on request. There is a surcharge per night for this.
- Moving cupboards and beds and the like, as well as sound or television equipment or taking any part of the indoor inventory outside (except, of course, dishes, glasses and cutlery for your meal outside) is expressly not allowed.
- Use of the fireplace is not allowed.
- Electric cars may not be charged at/in our villa. The electricity network is not designed for this.
- Parking is available in the villa’s driveway. There is space for about 3 cars.
- The villa has a Securitas security system equipped with magnets on all doors and motion detectors in the villa. During your stay, this system is switched off. It is not allowed to switch on this security system.
- You may use the office facilities such as desk, desk chair and two monitors with keyboard and mouse. You can connect your laptop to the docking station using a USB cable. You are not allowed to move and/or disconnect cables and/or equipment.
- There is air conditioning in the naya (conservatory) and rear bedroom. The air conditioner in the naya provides sufficient cooling for the adjacent two bedrooms and the rest of the villa. There are 2 fans you can use extra for extra comfort. There are 2 fans you can use for extra comfort.
- Please do not wear high heels in the naya/serre due to the vinyl floor.
- Fibre-optic internet is available in the villa. Super fast WiFi network throughout the villa and garden/pool area. There is a smart TV in the naya where you can watch TV, films and series via Canal Digital, Rakuten or Netflix and several other apps.
- You may use all equipment such as dishwasher, ovens, microwaves, fridge, freezer, washing machine and tumble dryer. The filters of the dryer should be emptied at each use (water bin and dust filter). All equipment needs to be left cleaned.
- Due to septic tanks, no waste such as sanitary towels, wipes, tampons, etc. may be thrown into the toilets. Only use of toilet paper is allowed.
